SALES TERMS AND CONDITIONS
This represents an agreement between Fountain Food Products Ltd. (hereinafter called “the Company”) and Customer who has set up an account for ordering goods and services under the trade names of “Cool” or “Fountain Food”. Please read the Terms and Conditions carefully.
1. Registration
1.1. Customer is required to register with the Company before ordering and agrees to provide sufficient information for account opening and thereafter maintenance. The information provided by Customer must be accurate, complete and updated such that the Company may rely on it to provide goods and services.
1.2. Customer further agrees that the Company may transfer and disclose partial or all of the information to any third parties appointed by the Company for the provision of goods and services.
1.3. Customer acknowledges that additional terms and conditions of credit account or standing payment authorization and any signed agreement in force will apply and prevail over these Terms & Conditions to the extent of any inconsistency.
1.4. If Customer has not purchased for a specific period or closed the account, for protection of mutual interest, the Company will deem the account to be no longer in use, deactivate it and further delete the account information after maximum 7 years of retention. Such information includes but not limited to contact and transaction records.
2. Ordering
2.1. Carboy products
- Customer will be provided a customer code and PIN code for ordering. For carboy order there is minimum order quantity of 2 bottles unless as specified. Customer may order with any of the following methods before the cut-off time 17:00 one working day prior to the coming delivery schedule. The Company will disregard all previous carboy orders and proceed only the latest one on the same delivery date.

2.2. Consumer packs
- Customer may order consumer packs together with your carboy order. For retail business the Company has appointed a third party for sales and distribution, Customer may make your enquiry for “Cool” at 2660-1515 or “Fountain Food” at 2126-7077.
2.3. Water dispensers and service programs
- All sales electrical dispensers being used properly are under one year warranty from purchase date with coverage on electrical and mechanical parts. For any defects or damages caused by misuse or any circumstances beyond the control of the Company including any accidents or Acts of Gods, the Company is not obliged to render any services or replacement.
- The Company is not liable for any damages, liabilities or claims arising directly or indirectly from the dispensers.
- Obsolete dispenser or normal wear and tear
- Misuse or inappropriate placement of dispenser
- Unauthorized modifications or repairs to the dispensers
- Use of other brands’ carboy product
- In case dispenser parts become unavailable, Customer accepts to take any solution determined the Company in its sole discretion and agrees to discharge the Company from all claims consequence of the dispensers or any part thereof not being restored to proper function.
- The above terms also apply to the subscription of any maintenance and cleaning programs
3. Charges and Payment
3.1. All prices are subject to the Company listed or Customer price per the signed agreement in effect or specific quantity of eVoucher and are determined by delivery date and location. Customer accepts that surcharges will be applied in the following situations:
- HK$5 for single bottle order
- HK$5 for each unit of goods per floor will be charged from 21st to 40th staircases that is inaccessible by elevator or corresponding delivery distance.
- Extra transportation fee separately quoted for locations in outlying islands including Lantau Island (except Tung Chung), Lamma Island, Cheung Chau, Peng Chau and Ma Wan
3.2. Customer is liable for the HK$50 delivery charge of cancelled order due to failure of notification before the order cut-off time, nobody or unreasonable rejection at Customer side.
3.3. Bottle deposit will be charged for loan of additional bottle(s) or crate(s) and in the first time delivery. The Company will arrange refund with no interest to Customer upon return of bottles or crates in good condition. In case the amount exceeding HK$100 it will be credited or paid by crossed cheque to the registered account. When any bottle found damaged or polluted, the Company reserves right to reject collection of bottle(s) and ask for a cost-compensation at $50 per each bottle as is the reported case of lost bottle.
3.4. The Company accepts the following payment methods:
- Cash on delivery: Please ready exact amount and hand to the Company delivery crew
- Crossed cheque: Please prepare a crossed cheque payable to “Fountain Food”. Post-dated cheque is not accepted
- Credit: Customer who has set up a credit account the order amount will be billed to it on condition that the account is normal, in good standing with no delinquent record
- Visa or Master credit card: Please fill an authorization form and provide a copy of both sides of the card for verification, if necessary.
- eVoucher: Each eVoucher can redeem one bottle of Office Size Cool Distilled Water and data will be updated per delivered transactions and shown on recent invoice. If there is insufficient eVoucher, Customer price will be charged for extra carboy. eVouchers valid period shall refer to its issuance to expiry date, all depends respective signed agreement or package scheme. It is neither transferable nor refundable and inapplicable to non-registered address.
Note: All dispenser or eVoucher packages are required full payment by cheque or credit card before delivery; otherwise the Company has the right to decline delivery.
3.5. New credit account will be preset to receive free e-Statement. If customer requests to receive paper statement or fails to provide valid email address or fax number, each account’s paper statement will be billed at HK$20 in that month. For e-Statement registration and email or fax number update, please contact us and select “Bill Enquiry” to send us your preference.
3.6 If the Customer has not ordered the carboy water service for one year and fails to return the water bottle, the Company has the right to charge $50 for each water bottle. The charge will be deducted from the deposit, any difference will be recovered from the Customer.
3.7 If the Customer has not ordered the carboy water service for one year and fails to return the water dispenser and cup holder, the Company has the right to charge $220 for each cup holder and charge for each water dispenser based on the price list set out in the [Loan Agreement Cool Dispenser ] entered into with the Customer. The charge will be deducted from the deposit, any difference will be recovered from the Customer.
4. Delivery
4.1. Delivery service is only available in Hong Kong locations accessible by truck within normal office hours from 09:00 to 18:00, Monday to Saturday (excluding all Sundays and statutory holidays).
4.2. The Company reserves all rights to accept or reject orders subject to the availability of goods and resources and will give notification to Customer on or before the day of delivery.
4.3. Delivery will be delayed or postponed when typhoon signal No.8 or above or black rainstorm warning is in effect, or under any circumstances beyond the control of the Company including but not limited to traffic congestion or redirection. The Company will prioritize outstanding orders on the other day or next schedule whichever is earlier but will accept no liability for loss arising from the delivery delay.
4.4. Customer agrees that all goods sold are non-refundable and the title is still with the Company until Customer has made full payment. For items on loan to Customer they remain the absolute property of the Company and should they be lost, stolen or damage by misuse, fire, flood whatsoever, the Company reserves the right to retain the deposit and request Customer to reimburse the difference between total cost and the current market value as determined solely by the Company.
4.5. Customer also accepts that the risk of any loss or damage to the received goods will be with Customer on arrival (including goods left unattended at any designated place requested by Customer) and Customer will be bound to accept the goods after 7 days from the delivery if the Company does not hear any notification of problem found on the received goods.
5. General
5.1. The Company may from time to time revise these Terms & Conditions by posting in the Company’s website https://www.varecool.com/ or updating Customer in one or a combination of ways (including by post, email, fax, SMS, phone call or voice message). It will be effective when they are sent. By placing an order Customer agrees to be bound by the Terms & Conditions.
5.2. The Company reserves all rights to amend goods and services offer, pricing adjustment and to make final decision on any disputes.
